The Gift of Equity
A powerful — and often overlooked — tool for keeping a family home in the family.
What Is a Gift of Equity?
A gift of equity occurs when a family member sells or transfers a property to another family member at a price below its current market value. The difference between the market value and the sale price is considered the "gift" — and that difference can be used as the buyer's down payment, reducing or even eliminating the need for cash out of pocket.
When Does It Apply?
This tool is especially valuable when dealing with an estate. If a relative has passed away and left behind a home, surviving family members may want to purchase or assume ownership of that property — but may not have the liquid funds for a traditional down payment. A gift of equity allows the estate (or a co-heir) to transfer the property at a reduced price, with the equity difference serving as the buyer's contribution.
How Does It Work?
Get the Home Appraised
A licensed appraiser determines the current fair market value of the property. This establishes the baseline for calculating the gift amount.
Agree on a Sale Price
The seller (or estate) and buyer agree on a purchase price below market value. The difference between the appraised value and the sale price becomes the gift of equity.
Document the Gift
A formal gift letter is prepared, signed by both parties, confirming the amount of equity being gifted and that no repayment is expected. Lenders require this letter.
Apply for a Mortgage
The buyer applies for a mortgage using the gift of equity as their down payment. Many loan types — including FHA, conventional, and VA — accept gifts of equity from family members.

Tax Implications
The IRS may consider a gift of equity a taxable gift if it exceeds the annual exclusion limit. Consult a tax professional or estate attorney to understand your specific situation.
Loan Type Requirements
Different loan programs have different rules. FHA loans are particularly flexible with gifts of equity from family members. Conventional loans may require the buyer to contribute a minimum amount of their own funds depending on the loan-to-value ratio.
Family Member Definition
Most lenders define eligible family members as spouses, parents, children, siblings, grandparents, and domestic partners. The relationship must be documented.
